Terms of Service

This is the agreement between you and Skomi. It is written to be read, so if anything below is unclear, ask us before you agree to it rather than after.

Skomi is operated by Skomi OÜ, registered in Estonia. Where these documents say "we", "us" or "Skomi", they mean that company.

1. What Skomi is

Skomi is a hosted service for measuring sites and apps. You add one script to a site you control, and Skomi collects and reports on what happens there. It is sold as a subscription with four products: Analytics, Behavior and Feedback, which you switch on per site, and App Analytics for applications you measure with an SDK.

Using Skomi means agreeing to these terms. If you are agreeing on behalf of a company, you are confirming that you are allowed to.

2. Your account

You need an account, and a confirmed email address, before Skomi will collect anything. Keep the account details accurate: the email address is how we reach you about billing, about security, and about anything that changes materially.

You are responsible for what happens under your account, including what people you have invited do with the sites you shared with them. Two-factor authentication is available and we recommend it. Tell us promptly if you think someone else has your credentials.

One person or company per account. Sharing one login between several people is how an account ends up with nobody able to say who changed something.

3. What you may collect

This is the clause that matters most, and it is your responsibility rather than ours. You may only install Skomi on sites and apps you own or are authorised to measure, and you must be allowed to collect the data you send us.

In particular:

  • You must give your visitors the information your own law requires: a privacy notice that describes the measurement, at minimum.
  • Skomi's tracker is cookieless by default and stores nothing on a visitor's device, which is why most sites need no consent banner for it. If you turn on device identity for a site, that stops being true and getting consent is your job.
  • Session recordings and heatmaps capture what a visitor did on a page. Skomi masks input contents and honours Global Privacy Control when you switch that on, but deciding whether recording is appropriate for a given page is yours.
  • Custom properties and event names are yours to choose. Do not put personal data in them. Skomi cannot tell that a property called email holds one. The same applies to the user id described below: it is a reference to a person in your own records, not a place to put their name, their address or their phone number.
  • Identifying your own users is off until you switch it on. With it on, your site may send us its own id for a signed-in person, so your reports can answer what one customer did. That id is your data about your own user: the lawful basis for it is yours to establish, and your privacy notice has to cover sending it to us. Send an opaque id or a hash. Skomi refuses anything that looks like an email address, in the browser and again on our servers.
  • Do not use Skomi to work out who an unidentified visitor is, to track people across sites you do not own, or to collect data about children where your law does not allow it. Identifying a person who is already your user, through the setting above, is not that.

We may suspend collection for a site that breaks this section.

4. Acceptable use

Do not use Skomi to break the law, to infringe somebody's rights, to send us malicious content, or to attack the service or anyone else through it. Do not attempt to gain access to data that is not yours, to reverse the service's access controls, or to resell Skomi as your own product without a written agreement.

Automated access through the query API is welcome within the published rate limits. Working around those limits is not.

5. Who owns what

Your data stays yours. The measurements collected from your sites, the settings you configure and the content you upload belong to you. We process them to run the service for you and for no other purpose: we do not sell them, we do not use them to build a product for anyone else, and we do not use them to train models.

Skomi itself (the software, the site, the name and the design) stays ours.

We keep aggregate operational statistics about the service, such as how much traffic it handles. Those never identify a customer's site or its visitors.

6. Plans, billing and payment

Subscriptions are billed monthly or annually in advance. Prices are on the pricing page and each plan's limits are part of it. There is also a free plan, which does not expire.

Your currency follows the country you are in and is fixed when the subscription starts. We never convert between currencies, and a later price change leaves an existing subscription on the terms it was bought under.

Paddle is the merchant of record for every Skomi purchase. That means Paddle sells the subscription to you, handles the payment, charges any tax that applies where you are, and appears on your statement and invoice. Their buyer terms apply to the transaction alongside these terms. We never see or store your card details.

Going over a plan's limits does not switch anything off. Usage above the plan is billed as overage at the published rate, or drawn from account credit where you hold some.

Prices can change. We will tell you at least 30 days before a change affects a subscription you already hold, and the change takes effect at your next renewal, never mid-term.

7. Cancelling

You can cancel at any time from the billing page. Cancelling stops the next renewal; the subscription runs to the end of the period you have already paid for.

Refunds are separate from cancelling and are governed by Paddle's refund policy, since Paddle is the merchant of record for the purchase. See the refund policy.

8. Ending it from our side

We can suspend or close an account that does not pay, that breaks section 3 or 4, or that we are required by law to close. Except where the law or an active attack forces our hand, we will tell you first and give you a reasonable chance to fix it.

If your account closes for any reason, you can export your data for 30 days afterwards. After that it is deleted on the schedule in the privacy policy, and deletion is permanent. We cannot recover it for you later.

9. Availability

We work to keep Skomi running and we monitor it, but at this stage we do not offer a contractual uptime guarantee. Saying otherwise would be easy and untrue. Planned maintenance is announced in advance where we can.

Collection is designed to fail safe: if reporting is unavailable, the tracker keeps queueing and the data arrives late rather than not at all.

10. Changes to these terms

We can change these terms. For a change that materially affects you we will give at least 30 days' notice by email to the account address, and the date at the top of this page always says when it last changed. Continuing to use Skomi after a change takes effect is how you accept it; if you would rather not, cancel before then.

11. Liability

Skomi is provided as it is. To the extent the law allows, we exclude implied warranties, and we are not liable for indirect or consequential loss, for lost profits, or for data you did not keep a copy of elsewhere.

Where we are liable, our total liability for all claims in any twelve-month period is limited to what you paid us in that period.

Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.

12. Law and disputes

These terms are governed by the law of Estonia, and the courts there have exclusive jurisdiction. If you are a consumer, this does not take away rights you have under the law of the country you live in.

These terms were written in English, and translations are provided so you can read them in your own language. If a translation and the English version disagree, the English version is the one that governs. If you are a consumer, this does not take away the protection of the version you were actually shown.
